These Terms & Conditions (“Terms”) govern your access to and use of FreshStartGlobalEnterprise.com, our websites, online platforms, products, programs, digital resources, software, memberships, consultations, and other services that link to these Terms.
For purposes of these Terms, “Fresh Start,” “we,” “us,” and “our” refer to Fresh Start Global Enterprise and, where applicable, affiliated Fresh Start companies, brands, programs, and service providers, including Fresh Start Business Service. By accessing our website, creating an account, purchasing a product or service, enrolling in a program, scheduling a consultation, subscribing to a service, or otherwise using our services, you agree to these Terms. If you do not agree with these Terms, please do not use our website or services.
1. Eligibility and Use of Our Website
You must be at least 18 years old or otherwise have the legal capacity to enter into a binding agreement to purchase our general business, professional, software, or educational services.
You agree to use our website and services only for lawful purposes.
You may not:
• Use the website for fraudulent, illegal, or unauthorized activity
• Attempt to gain unauthorized access to our website, accounts, systems, or data
• Introduce viruses, malware, harmful code, or other disruptive technology
• Scrape, copy, reproduce, or commercially exploit website content without permission
• Use another person's identity or account without authorization
• Interfere with the operation or security of our website or services
• Use our intellectual property without authorization
• Submit false, misleading, fraudulent, or unlawful information
We may restrict or terminate access when we reasonably believe these Terms have been violated or when necessary to protect Fresh Start, our customers, our systems, or others.
2. Fresh Start Companies, Programs, and Services
Fresh Start Global Enterprise serves as the primary online presence for multiple Fresh Start services, programs, companies, and initiatives. Services available through or connected with this website may include, depending on availability:
• Business consulting and business support services
• Tax and financial-related professional services
• Bookkeeping or accounting support
• Business formation and administrative services
• Educational programs, courses, workshops, and training
• Coaching and consulting
• Software and technology solutions
• Digital products and downloadable resources
• Memberships and subscription-based services
• Events and community programs
• Other professional and business services
Not every service is provided by the same Fresh Start company or professional.
The applicable Fresh Start entity, service provider, program, or professional may be identified during enrollment, checkout, engagement, onboarding, or through a separate agreement.
3. Separate Service Agreements
Certain services may require you to sign or accept an additional agreement, including an:
• Engagement letter
• Service agreement
• Client agreement
• Enrollment agreement
• Software license or subscription agreement
• Payment plan agreement
• Coaching or consulting agreement
• Tax engagement agreement
• Program-specific terms
When separate written terms apply to a particular service, those specific terms will control that service if there is a conflict between those terms and these general website Terms.
These Terms do not replace any separately executed professional services agreement.
4. Accounts and Client Information
Some services may require you to create an account, client portal, or user profile.
You are responsible for:
• Providing accurate and current information
• Maintaining the confidentiality of your login credentials
• Protecting access to your account
• Promptly notifying us of suspected unauthorized access
• Keeping your email address, telephone number, payment information, and other necessary information current. You are responsible for activity occurring through your account unless prohibited by law. We may suspend access to an account when reasonably necessary to investigate security, fraud, payment, or policy concerns.
5. Purchases and Payments
Prices and payment terms will be disclosed at checkout, during enrollment, in a proposal, invoice, engagement agreement, or other applicable documentation.
By purchasing a product or service, you authorize us and our payment providers to charge the payment method you provide for the amount presented to you.
You agree to provide accurate billing and payment information.
We may:
• Correct pricing or billing errors
• Decline or cancel transactions when fraud or unauthorized activity is suspected
• Require payment before services begin
• Require deposits, retainers, installment payments, or recurring payments for certain services
• Suspend services when payments become overdue, where permitted by the applicable agreement and law. Additional payment terms may apply to particular products or services.
6. Payment Plans
When a payment plan is offered, you remain responsible for the full financial obligation you accepted unless your applicable agreement expressly provides otherwise. Stopping use of a service, failing to attend sessions, failing to complete a program, or deciding not to continue does not automatically cancel an outstanding contractual payment obligation. Payment-plan terms presented at enrollment or contained in a separate agreement will apply.
7. Recurring Memberships and Subscriptions
Certain software, memberships, programs, or other services may automatically renew.
When automatic renewal applies, the recurring price, billing frequency, and material subscription terms will be disclosed at or before enrollment. By enrolling in an automatically renewing service, you authorize recurring charges to your selected payment method until the subscription is canceled in accordance with the applicable cancellation procedure.
Cancellation stops future renewal charges after the applicable cancellation becomes effective. Unless otherwise required by law or expressly stated in the applicable offer, cancellation does not automatically generate a refund for previously charged subscription periods. Instructions for cancellation will be made reasonably available through the applicable platform, account, agreement, or customer service process.
8. Refunds and Cancellations
Purchases are subject to our separate Refund & Cancellation Policy, which is incorporated into these Terms by reference. Certain products and services are non-refundable due to their nature, including services already performed, certain digital products, downloaded materials, accessed courses, completed consultations, custom work, and other products or services identified as non-refundable at the time of purchase. Specific programs or professional services may have different cancellation or refund terms. When they do, the terms presented at purchase or contained in your separate agreement will apply. Nothing in these Terms eliminates a refund, cancellation, or other consumer right that cannot legally be waived.
9. Appointments, Consultations, and No-Shows
Appointments and consultations may be subject to cancellation or rescheduling requirements disclosed when booking. Late cancellations, missed appointments, and no-shows may result in the loss of the appointment fee, consultation fee, or deposit where disclosed and permitted by law. Repeated missed appointments may result in restrictions on future bookings. Additional appointment requirements may apply to specific services.
10. Digital Products
Digital products may include templates, workbooks, e-books, guides, downloadable documents, recordings, training materials, forms, digital resources, or similar content.
Digital products are licensed to the purchaser for personal or authorized internal business use unless otherwise stated. Purchasing a digital product does not transfer ownership of the underlying intellectual property.
You may not:
• Resell the product
• Redistribute the product
• Upload it to file-sharing platforms
• Share paid access with unauthorized users
• Rebrand our materials as your own
• Copy or reproduce substantial portions for commercial resale
• Remove proprietary notices
Unauthorized reproduction or distribution may result in termination of access and enforcement of applicable intellectual property rights.
11. Courses, Academy Programs, and Educational Content
Educational programs are designed to provide information, training, skill development, and professional or business education.
Participation does not guarantee:
• Income
• Revenue
• Employment
• Business success
• Certification unless specifically stated
• Licensing
• Financing
• Tax outcomes
• Credit outcomes
• Specific professional results
Your results depend on numerous circumstances, including your effort, implementation, experience, decisions, resources, market conditions, and other factors outside our control.
Any testimonials, case studies, examples, revenue references, or success stories represent individual experiences and are not guarantees of future results.
12. Professional Services and General Information
Information presented on our public website, social media channels, educational materials, webinars, courses, emails, or other general content is provided for informational and educational purposes. General website content should not be treated as individualized legal, tax, accounting, investment, financial, credit, or other professional advice.
Professional advice or services are established only through an applicable client engagement or service relationship. Tax, accounting, bookkeeping, consulting, or other professional services may be governed by separate engagement terms and professional requirements.
13. Client Responsibilities
Successful completion of many Fresh Start services depends on timely cooperation from the client.
You agree, when applicable, to:
• Provide accurate information
• Provide requested documents
• Respond to communications within reasonable timeframes
• Review documents before approval or submission
• Meet deadlines communicated to you
• Inform us of material changes
• Maintain your own records where appropriate
Fresh Start is not responsible for delays or consequences caused by inaccurate information, incomplete documentation, missed deadlines, failure to respond, or other circumstances within the client's control.
14. Software and Technology Services
Certain Fresh Start services may involve software, platforms, portals, applications, automation, artificial intelligence, third-party integrations, or other technology.
Software and technology features may be updated, modified, improved, discontinued, interrupted, or replaced from time to time. We do not guarantee that every technology service will operate uninterrupted or error-free. Your use of certain platforms may also be governed by the terms and privacy practices of the applicable third-party provider.
15. Third-Party Services and Links
Our website and services may connect to or use third-party:
• Payment processors

• Other websites or applications
Fresh Start does not control independent third-party websites or services and is not responsible for their separate content, availability, policies, security, or business practices.
Your use of third-party services may be governed by their own terms and privacy policies.
16. Intellectual Property
Unless otherwise stated, the content available through Fresh Start websites, programs, platforms, and services is owned by or licensed to Fresh Start.
This may include:
• Logos
• Brand names
• Course materials

• Written materials
• Website copy
• Designs
• Processes

• Other proprietary materials
Our materials may not be reproduced, sold, distributed, modified, republished, licensed, or commercially exploited without written authorization except as expressly permitted.
All rights not expressly granted are reserved.
17. User Submissions, Reviews, and Feedback
If you submit a review, testimonial, comment, suggestion, or other non-confidential feedback to Fresh Start, you represent that you have the right to submit it. We may use voluntarily provided reviews or testimonials for business and marketing purposes when permitted by law and consistent with any authorization you provide. We will not intentionally publish confidential client information merely because it was provided to us as part of a professional service relationship. Suggestions or general feedback about our products or services may be used to improve our business without an obligation to compensate you unless otherwise agreed in writing.
18. Privacy
Our collection and use of personal information is governed by our Privacy Policy.
Additional privacy, confidentiality, information-security, or professional requirements may apply to certain tax, financial, business, software, or professional services.
19. Electronic Communications
By communicating with us electronically, creating an account, submitting a form, or purchasing a service online, you consent to receive communications electronically when permitted by law.
Electronic communications may include:
• Order confirmations
• Appointment notices
• Account notices
• Service communications
• Electronic agreements
• Invoices
• Program communications
• Security notifications
Marketing email and text-message communications are subject to the consent and opt-out practices described in our Privacy Policy and applicable enrollment terms.
20. Accuracy of Website Information
We make reasonable efforts to provide useful and accurate information.
However, website information may occasionally contain errors, outdated information, omissions, pricing inaccuracies, or typographical mistakes. We reserve the right to correct errors and update website information. If an error materially affects a purchase already made, we will address the transaction in accordance with applicable law and our policies.
21. Changes to Products, Services, and Pricing
Products, services, features, availability, and pricing may change.
We may add, modify, suspend, or discontinue offerings when reasonably necessary.
Changes will not retroactively alter a customer's existing contractual rights unless permitted by the applicable agreement and law.
22. No Guarantee of Results
Fresh Start does not guarantee a particular financial, business, tax, credit, educational, software, professional, or other outcome unless an express written guarantee is specifically provided. Business and financial results involve factors outside our control. You remain responsible for your own decisions and implementation.
23. Disclaimer of Warranties
To the fullest extent permitted by applicable law, our general website and website content are provided on an “as available” basis. We do not guarantee that the public website will always be uninterrupted, completely error-free, or free from every security threat.
Any warranties applicable to a specific product, software service, or professional service will be those expressly stated in the applicable agreement or those required by law.
Nothing in these Terms excludes a warranty or consumer protection that cannot lawfully be excluded.
24. Limitation of Liability
To the fullest extent permitted by applicable law, Fresh Start and its applicable affiliated entities, owners, officers, directors, team members, contractors, service providers, and agents will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising solely from use of the public website or services, including lost profits or lost data, except where liability cannot legally be limited. For claims arising from a particular paid service, any limitation contained in the applicable service or engagement agreement will apply. Nothing in these Terms limits liability that applicable law does not permit us to limit or exclude.
25. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Fresh Start and its applicable affiliated entities, owners, officers, employees, contractors, and agents from third-party claims arising from your unlawful use of our website, your infringement of another person's rights, or your material violation of these Terms. This section does not require you to indemnify Fresh Start for conduct for which indemnification cannot legally be required.
26. Suspension and Termination
We may suspend or terminate access to our website, platform, program, or service when:
• These Terms are materially violated
• Fraud or unlawful activity is suspected
• Payment obligations are not satisfied
• Another person's rights or safety are threatened
• Our systems or intellectual property are abused
• Continued access would create a security or compliance risk
Termination does not automatically eliminate outstanding payment obligations or rights that arose before termination.
27. Force Majeure
Fresh Start will not be responsible for delay or failure caused by circumstances reasonably beyond our control, including natural disasters, severe weather, power or internet outages, governmental actions, cyber incidents affecting third-party infrastructure, labor disruptions, public emergencies, or failures of outside technology providers. We will make reasonable efforts to resume affected services when practical.
28. Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except where another law must apply. Any legal proceeding relating to these general website Terms shall be brought before a state or federal court with proper jurisdiction in Georgia unless applicable law, a separate written agreement, or another mandatory requirement provides otherwise.
29. Dispute Resolution
Before filing a legal claim relating to these general Terms, you and Fresh Start agree to make a reasonable good-faith effort to resolve the dispute informally. This requirement does not prevent either party from seeking emergency legal relief or exercising rights that cannot legally be restricted. Separate service agreements may contain additional dispute-resolution procedures.
30. Severability
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed if necessary.
The remaining provisions will continue in effect.
31. No Waiver
Failure to enforce a provision of these Terms does not waive our right to enforce that provision later.
32. Entire Agreement
These Terms, together with policies incorporated by reference, govern general use of our website. For a specific paid service, these Terms should be read with any applicable proposal, invoice, engagement letter, enrollment agreement, subscription agreement, or other written agreement.
33. Changes to These Terms
We may update these Terms as our website, services, business operations, technology, or legal obligations change. When updates are made, the Last Updated date will be revised.
Material changes will apply prospectively as required by law and will not improperly eliminate rights already established under an existing contract.
